For most people, what happens to their property and family when they die is a matter of some importance and making a Will is the only way you can ensure that your wishes are carried out after your death.
When a person dies without leaving a Will the law says they have died Intestate and the estate is divided among members of their family according to the rules laid down in the Administration of Estates Act, if there are no family members the estate can be forfeited to the state.
The fact that a couple have lived together for many years gives no automatic entitlement to the estate of the first to die, unless they are married to each other or are in a legally assigned civil partnership.
Please remember, substantial savings in death duty can sometimes be made by having a Will.
